Training Registration, Cancellation and Refund Policy

1. Introduction

1.1

This Training Registration, Cancellation and Refund Policy (“Policy”) governs the registration, payment, attendance, cancellation, rescheduling, transfer and refund of fees for all training programmes offered by Almond Rouge (“Almond Rouge”, “we”, “us” or “our”).

1.2

This Policy applies to all participants (“Participants”, “you” or “your”) who register for any training programme offered by Almond Rouge, whether through our website, social media platforms, direct communication or any other authorised registration channel.

1.3

By registering for a training programme and making payment, you acknowledge that you have been given the opportunity to read and understand this Policy and agree to its applicable terms.

1.4

This Policy shall be read together with the relevant programme description, published training schedule, payment terms and any programme-specific conditions communicated before payment.

1.5

Nothing in this Policy shall exclude, restrict or waive any right or remedy available to a Participant under applicable Nigerian law.

2. Registration and Payment

2.1

Registration for a training programme shall be deemed complete upon confirmation of payment in accordance with the applicable registration requirements.

2.2

Before making payment, Participants are responsible for reviewing the programme description, training schedule, duration, delivery format, venue, fees and other material details relating to the programme.

2.3

All applicable fees, payment deadlines, instalment arrangements, discounts and additional charges shall be communicated to Participants before payment.

2.4

Registration is personal to the Participant and may not be transferred to another individual without the prior written approval of Almond Rouge.

2.5

Almond Rouge shall provide a written or electronic confirmation of registration and payment, containing the relevant transaction details.

3. Training Schedule and Attendance

3.1

The scheduled dates, times, duration, venue and delivery format of each training programme shall be communicated to Participants before registration.

3.2

Where a Participant becomes unable to attend a programme due to employment commitments, a change in work schedule, personal circumstances, travel or any other reason, the Participant shall notify Almond Rouge in writing as soon as reasonably practicable.

3.3

A Participant’s inability to attend a programme due to personal circumstances shall not, by itself, constitute a failure by Almond Rouge to provide the training, provided that the programme is delivered in accordance with the agreed terms.

3.4

Where practicable, Almond Rouge may offer a transfer to another cohort or an alternative learning arrangement, subject to availability and the terms of this Policy.

4. Cancellation by a Participant

4.1

A Participant who wishes to cancel their registration shall submit a written cancellation request through the official contact channels provided in this Policy.

4.2

The effective date of cancellation shall be the date on which Almond Rouge receives the written cancellation request.

4.3

Cancellation at least fourteen (14) calendar days before commencement

Where a Participant requests a cancellation fourteen (14) calendar days or more before commencement, they shall receive a full refund subject to an administrative fee of 10%.

A Participant may alternatively request a transfer to another available cohort, subject to approval and availability.

4.4

Cancellation between seven (7) and thirteen (13) calendar days before commencement

Where a cancellation is requested between seven (7) and thirteen (13) calendar days before commencement, a cancellation charge of 30% of the amount paid shall apply.

A Participant may alternatively request a transfer to another available cohort, subject to approval and availability.

4.5

Cancellation less than seven (7) calendar days before commencement

Where a cancellation is requested less than seven (7) calendar days before commencement, the Participant shall forfeit 100% of the amount paid, except in verified cases of sudden death or hospitalization as provided under Section 120(3) of the Federal Competition and Consumer Protection Act 2018.

Where a Participant submits a cancellation request less than seven (7) calendar days before the scheduled commencement of the programme, Almond Rouge shall assess the request on a case-by-case basis.

Almond Rouge may alternatively offer:

  1. A transfer to another available cohort;
  2. A credit towards another eligible training programme;
  3. Another mutually agreed arrangement.

The assessment shall take into account the timing of the request, costs reasonably incurred, the possibility of filling the Participant’s place and the extent of any services already provided.

4.6

Cancellation on or after commencement

Where a Participant requests cancellation on or after the commencement of a programme, a refund shall not be available solely because the Participant is unable to attend, has missed sessions or has decided not to continue.

Almond Rouge may, at its discretion, offer a transfer, credit or other reasonable alternative.

4.7

Exceptions

No cancellation charge shall be imposed in circumstances where a consumer is unable to honour a training paid for due to death or hospitalisation as provided under Section 120(3) of the Federal Competition and Consumer Protection Act 2018.

5. Inability to Attend Due to Employment or Personal Circumstances

5.1

Where a Participant becomes unable to attend a programme due to a new job, a change in work schedule, personal commitments or any other circumstance arising after registration, the Participant may request cancellation in accordance with Clause 4 of this Policy.

5.2

A Participant who submits a cancellation request within the applicable cancellation period may be eligible for a refund, subject to the reasonable cancellation charge set out in this Policy.

5.3

Where the cancellation request is submitted after the applicable cancellation deadline, Almond Rouge may consider a transfer to another cohort, a credit or another reasonable alternative.

5.4

The commencement of employment or any other personal circumstance shall not automatically entitle a Participant to a full refund where Almond Rouge remains ready and able to provide the programme as advertised.

5.5

All requests shall be assessed fairly, taking into account the relevant circumstances and any applicable legal obligations.

6. Cancellation or Rescheduling by Almond Rouge

6.1

Almond Rouge reserves the right to reschedule, postpone, modify or cancel a training programme where reasonably necessary due to unforeseen circumstances, operational requirements, instructor unavailability or other circumstances affecting delivery.

6.2

Where a programme is postponed or rescheduled, Almond Rouge shall notify registered Participants within a reasonable time and communicate the revised schedule.

6.3

Where a programme is postponed or rescheduled, Almond Rouge shall first offer Participants the opportunity to transfer their registration to the revised schedule or another available cohort.

6.4

Where a Participant declines the proposed alternative arrangement, the Participant may request a refund of the amount paid for the affected programme, without a cancellation charge, subject to applicable law.

6.5

Where Almond Rouge cancels a programme without providing an acceptable alternative, the Participant shall be entitled to a refund of the amount paid for the cancelled programme.

6.6

Where a programme has commenced but Almond Rouge is unable to complete the training as agreed, Almond Rouge shall determine an appropriate remedy, which may include a refund of a reasonable portion of the fees paid, having regard to the services already delivered and applicable law.

7. Transfer of Registration

7.1

A Participant may request to transfer their registration to another individual, subject to the prior written approval of Almond Rouge.

7.2

All transfer requests shall be submitted in writing before the commencement of the relevant programme.

7.3

The proposed transferee must satisfy any applicable eligibility requirements for the programme.

7.4

Almond Rouge may approve or decline a transfer request on reasonable grounds, including programme capacity, eligibility requirements and administrative considerations.

7.5

An approved transfer shall not entitle the original Participant to a refund of the registration fee.

7.6

Any transfer to another cohort shall be subject to availability and any applicable difference in programme fees.

8. Instalment Payment Arrangements

8.1

Almond Rouge may permit Participants to pay programme fees in instalments where such an arrangement is expressly offered and agreed before registration.

8.2

The total programme fee, number of instalments, amount of each instalment and applicable payment deadlines shall be communicated to the Participant before payment.

8.3

Participants who elect to pay by instalments are required to comply with the agreed payment schedule.

8.4

Where a Participant fails to make an instalment payment by the agreed deadline, Almond Rouge may issue a reminder and request payment within a reasonable period.

8.5

Where an instalment remains unpaid after the applicable payment deadline, Almond Rouge may suspend the Participant’s access to the programme or take other reasonable steps consistent with the agreed payment terms and applicable law.

8.6

Where a Participant cancels a registration under an instalment arrangement, the refund, if any, shall be subject to Clause 4 of this Policy.

8.7

Any approved refund shall be processed in accordance with Clause 10 of this Policy.

9. Non-Attendance and Missed Sessions

9.1

A Participant who fails to attend a training session without prior notice shall not automatically be entitled to a refund, transfer or replacement session.

9.2

Where a Participant misses a session, Almond Rouge may, where practicable, provide access to available learning materials, a make-up session or another reasonable alternative.

9.3

The availability of recordings, supplementary materials or make-up sessions shall depend on the nature of the programme and shall be communicated to Participants where applicable.

9.4

Where Almond Rouge is responsible for a missed session or a material interruption in the delivery of a programme, appropriate arrangements shall be made to address the affected session.

10. Refund Request Procedure

10.1

All refund requests shall be submitted in writing through the official contact channels provided in this Policy.

10.2

A refund request shall include:

  1. The Participant’s full name;
  2. The name of the training programme;
  3. The date of registration and payment;
  4. The payment reference or proof of payment;
  5. The reason for the refund request; and
  6. Any other information reasonably required to verify the transaction.
10.3

Almond Rouge shall acknowledge a refund request within three (3) business days of receipt.

10.4

A decision on the refund request shall ordinarily be communicated within seven (7) business days after receipt of all information reasonably required to assess the request.

10.5

Where a refund is approved, Almond Rouge shall initiate payment within fourteen (14) business days, subject to the processing requirements of the relevant payment provider or financial institution.

10.6

Refunds shall ordinarily be made through the original payment method. Where that method is unavailable, Almond Rouge shall agree with the Participant on a reasonable alternative.

10.7

Any deduction from a refund shall be reasonable, properly disclosed and permitted by applicable law.

11. Complaints and Dispute Resolution

11.1

A Participant who is dissatisfied with the handling of a cancellation, refund, transfer or any other matter relating to a training programme may submit a written complaint to Almond Rouge.

11.2

Almond Rouge shall review the complaint and make reasonable efforts to resolve it fairly and promptly.

11.3

Where a dispute cannot be resolved through direct communication, either party may pursue any remedy available under applicable Nigerian law, including recourse to the appropriate consumer protection or judicial authority.

11.4

Nothing in this Policy shall prevent a Participant from exercising any statutory right to seek redress.

12. Data Protection

12.1

Personal information provided in connection with registration, payment, cancellation, refund requests or complaints shall be processed for legitimate purposes connected with the administration of the programme and the resolution of related matters.

12.2

Almond Rouge shall handle such information in accordance with applicable Nigerian data protection laws and its Privacy Policy.

13. Amendments to this Policy

13.1

Almond Rouge may review and update this Policy from time to time.

13.2

Any revised Policy shall be published on the Almond Rouge website with its effective date.

13.3

Material changes shall not retrospectively remove rights or remedies already accrued to a Participant under applicable law or the terms governing an existing registration.

13.4

The version of this Policy applicable to a Participant’s registration shall be the version made available before or at the time of payment, subject to applicable law.

14. Governing Law

14.1

This Policy shall be governed by the laws of the Federal Republic of Nigeria, including the Federal Competition and Consumer Protection Act 2018 and other applicable laws.

By completing registration and payment for a training programme, the Participant acknowledges that they have been given the opportunity to review this Policy and agrees to its applicable terms, subject to the rights and remedies available under Nigerian law.
